Jeff Ross

Jeff Ross is nationally recognized for his expertise in representing individual and institutional investors in securities litigation. He has achieved noteworthy results on behalf of his clients in several large-scale frauds including MF Global, Madoff, WorldCom, HealthSouth, and Adelphia. Jeff has litigated many securities cases to a successful resolution, including one in which he was co-lead counsel that resulted in a $140 million jury award against Bank of America. Jeff serves as litigation counsel to several institutional investors.

  • Favorable resolution of securities fraud claims on behalf of institutional holders of a significant portion of MF Global bonds.  AG Oncon, LLC, et al. v. Corzine, et al., 14 Civ. 396 (S.D.N.Y.).
  • Resolution of claims on behalf of 200 investors in Madoff feeder funds, achieving results significantly more favorable than other similarly situated Madoff investors.  Cocchi, et al. v. Tremont Group Holdings, et al., 12 Civ. 9064 (S.D.N.Y.).
  • Actions taken to trial for institutional investor against Carl Icahn (further proceedings pending).  R2 Investments LDC v. Icahn, et al., Index No. 601296/09 (Sup. Ct. N.Y. County); Nineteen Eighty-Nine LLC v. Icahn, et al., Index. No. 601265/07 (Sup. Ct. N.Y. County).
  • Defense verdict for director in breach of fiduciary duty trial.  DQ Wind-Up Inc. Trust v. Kohler, 27-CV-10-27509 (Dist. Ct. Hennepin County, MN).
  • Co-lead counsel in resolution of claims of 90 investors in Mortgages, Ltd. Ponzi scheme, achieving results significantly more favorable than other similarly situated Mortgages, Ltd. investors.  (Final approval of settlement pending.)  Ashkenazi, et al. v. Greenberg Traurig, LLP, et al., CV2010-020851 (Super. Ct. Maricopa County).
  • Dismissal of retaliatory antitrust claims brought by bond issuer against 10 hedge funds that previously claimed issuer’s management was engaging in self-dealing that violated uniform fraudulent transfer act. CompuCreditHoldings Corp. v. Akanthos Capital management, 677 F.3d 1042 (11th Cir. 2012) (currently pending en banc reargument).
  • Co-lead counsel in 6-week jury trial resulting in $140 million judgment against Banc of America Securities for underwriting fraud with respect to the sale of asset backed securities. AIG Global Securities Lending Corp. v. Banc of America Securities LLC, 386 Fed. Appx. 5, (2nd Cir. 2010); 2008 WL 5521316 (S.D.N.Y. 2009) (Verdict Summary).
  • Ongoing recovery from several defendants so far totaling more than $100 million on behalf of 15 insurance companies, mutual funds and hedge funds defrauded in the Adelphia Communications Corp. accounting scandal of 2002.
  • Resolution of multimillion dollar fraud claims on behalf of three financial institutions against HealthSouth and related defendants arising out of the 2003 accounting fraud, for amounts that were multiples greater on a pro rata basis than class members received.
  • In a 2012 greenmail case, counsel for the two largest bondholders, together with the indenture trustee, stopping a minority bondholder from blocking an indenture amendment that would benefit all holders in a $520 million CBO. Commerzbank AG v. Deutsche Trustee Co. Ltd., Index No. 650722/2012 (Sup. Ct. N.Y. Co.).
  • Favorable settlement of a will dispute in $10 million estate involving questions of capacity and undue influence, following favorable ruling in New York appeals court. In re Will of Moles, 90 A.D.3d 473 (1st Dep’t 2011).
  • Representation of indenture trustees and note holders in various matters concerning issuer default, indenture interpretation and issuer misconduct.
